Terms of Service
The agreement between TravelOpen and the properties that use it.
Last updated 2026-09-09 · Operated by B.Army
TravelOpen is a software product owned and operated by B.Army ("we", "us"). This document is the agreement between us and the organisation using the service ("Customer", typically a property or a group of properties).
By creating an account, signing a service contract, or using TravelOpen, the Customer accepts these terms. Where we and the Customer have signed a separate contract, that contract prevails on any point where the two differ.
1. The service
TravelOpen is a property management system (PMS) with channel management, in which AI agents carry out part of the operational work: taking and processing bookings, syncing rates and availability to OTA channels, replying to guests, and related tasks.
The service is delivered as web-based software (SaaS). We may add, change or discontinue a specific feature; where a change materially reduces functionality in active use, we give at least 30 days' notice.
2. Human in the loop
AI agents act only within the limits the Customer configures. The Customer is responsible for setting appropriate guardrails — rate bands, booking confirmation authority, the scope of guest replies — and for reviewing them periodically.
Every agent action is written to an audit log the Customer can inspect. We are not liable for losses arising from guardrails the Customer set too wide, or from a failure to review the audit log.
3. Accounts and acceptable use
The Customer is responsible for keeping credentials confidential and for activity under its accounts, and must notify us as soon as it discovers unauthorised access.
The Customer agrees not to use the service unlawfully, not to probe or exploit vulnerabilities, not to access other customers' data, and not to send unsolicited bulk messages.
4. Third-party channels
TravelOpen connects to platforms such as Booking.com, Expedia, Agoda and Airbnb using the Customer's own accounts on those platforms. The Customer remains responsible for complying with each platform's terms.
We do not control those platforms and do not warrant their availability. A platform changing its API, suspending an account, or suffering an outage is not a breach by us.
5. Customer data
Data the Customer puts into the system — including booking and guest data — belongs to the Customer. We process it only to provide the service, under the Privacy Policy and the Data Processing Addendum.
We do not sell Customer data. On termination the Customer may request an export in a machine-readable format within 30 days of the termination date.
6. Fees and payment
Fees follow the published pricing at https://travelopen.ai/pricing or a separate quotation. VAT invoices are issued by B.Army.
Fees are payable in advance per billing period. We may suspend the service where an invoice is more than 15 days overdue, after written or email notice.
7. Service levels and support
We target 99.9% monthly availability for core functionality, excluding announced maintenance windows and force majeure events. The binding service-level commitment, its measurement method and any service credits are set out in the SLA annex to each Customer's contract.
8. Limitation of liability
To the extent permitted by law, our total liability for all claims arising in any 12-month period will not exceed the total fees the Customer paid in the 12 months preceding the claim.
We are not liable for indirect loss, lost profit, lost business opportunity, or data loss caused by factors outside our reasonable control.
These limits do not apply to loss caused by our wilful misconduct or gross negligence, and do not exclude liability that cannot lawfully be excluded.
9. Termination
Either party may terminate on 30 days' written notice. We may terminate immediately where the Customer materially breaches Section 3 or where payment is more than 45 days overdue.
After termination we retain Customer data for a further 30 days to allow export, then delete it under the process described in the Data Processing Addendum.
10. Governing law
This agreement is governed by the laws of Vietnam. Disputes are first addressed by negotiation; if unresolved after 30 days, they are referred to the competent courts of Vietnam.
